RG 92 Procedural fairness to third parties

Issued 6 February 1995

Updated 1 July 1996

This guide sets out how we will afford procedural fairness when exercising discretionary powers under the law.

Procedural fairness essentially has two rules:

  • the fair hearing rule; and
  • the no bias rule.

This guide focuses on when the fair hearing rule requires us to consult with third parties who may be adversely affected by a decision.
