Registered liquidator disciplinary decisions

Schedule 2 Committee referrals and decisions

Under s40-50 of Schedule 2 to the Corporations Act 2001 ASIC may refer a registered liquidator to a disciplinary committee.

The table below sets out the referrals made by ASIC to a disciplinary committee since 1 March 2017 (when this disciplinary regime started), and the results of those referrals where the committee has decided ASIC should publish information about the committee’s decision.

David Nicholas Iannuzzi’s liquidator registration was cancelled by ASIC on 12 November 2019 following ASIC’s receipt of sealed orders made by the Federal Court on 7 November 2019 in the matter of Commissioner of Taxation v Iannuzzi (No 2) [2019] FCA 1818. As a result of the cancellation the Committee is not able to make a decision on ASIC’s referral and will not consider the matter.

ASIC regulation of registered liquidators: July 2018 to June 2019                  

This report summarises the work undertaken and outcomes achieved by ASIC in supervising registered liquidators in the period from 1 July 2018 to 30 June 2019.

ASIC reports on corporate insolvencies 2018–19

ASIC has published its annual overview of corporate insolvencies for the 2018-19 financial year. 18 December 2019.

After an extensive revision process and industry consultation conducted through an external consultant, ASIC has released the new ROCAP - Report On Company Activities and Property to replace the RATA.
